infinitSpace – Referral Scheme Terms & Conditions

This Referral Terms & Conditions belongs to infinitSpace Holding BV, with registered and trading address at Fahrenheitstraat 99, 1097 PP Amsterdam, The Netherlands and registered with the Dutch Chamber of Commerce under number 80915876.

In this policy, "we", "us" and "our" refer to infinitSpace Holding BV (or one or more of its current or future affiliates).

 

DEFINITIONS

 

Broker

Any agency with which infinitSpace has an agreement to submit leads.

 

Qualified Referrer

An entity (consumer or company) that introduces a referral, this entity not being a broker or one of our employees.

 

Qualified Referral

Any entity (consumer or company) introduced by you to us.

A referral is considered as a Qualified Referral, only when all of the following criteria are met:

  • The Referral signs a Membership Agreement for one of the locations operated by us;
  • The Membership Agreement is signed within 2 months after introduction by Referrer;
  • This Membership Agreement is for a period of at least one full month;
  • The Membership Agreement is for a Dedicated Desk, Hotdesk or a Private Office;
  • The Referral was not already known by us, either:
    • via a Broker we have an agreement with;
    • or via another Referrer;
    • or by previously having been a member of one of our locations;
    • or by being (of having been) in one of our mailing lists.
  • The Referral was not introduced by one of our employees;
  • The Referral has authorised the Referrer to be contacted by us. Note that when the Referral has not authorised the Referrer to be contacted by us and this still leads to a signed membership, the Referrer won’t be rewarded.

 

Referral Reward Fee

The Referrer shall be entitled to receive a reward of £100 for each workstation successfully signed up by a referred individual or company (the “Referral”). The reward will only become payable once the Referral has moved into the workspace and the first membership payment has been received by infinitSpace. Upon confirmation, the reward is guaranteed and will be disbursed within thirty (30) days of the Referral’s move-in date. This reward applies exclusively to workstation sign-ups and excludes meeting rooms, event spaces, virtual office packages, or any other services. In the event of multiple Referrers claiming the same Referral, the reward will be granted to the first valid submission received by infinitSpace. Self-referrals are not permitted. infinitSpace reserves the right to amend, suspend, or withdraw this Referral Program and its Terms & Conditions at any time, without prior notice.

An example of the reward calculation:

For example, if the referral signs up for a 10-desk office, the reward will be £1,000 

 

GENERAL

We reward those who introduce Referrals to us, after this referral signs a Membership Agreement with us. This reward is subject to these terms and conditions.



PROCESS

  1. Referrals should be submitted via our website(s). You may submit multiple referrals, but one per submission. Incomplete submissions will be ineligible from the referral fee.
  2. We will check if the referral was not already known. If so, we will inform you that the referral is not qualified.
  3. If the referral is qualified, we will contact them (unless you specifically request us not to).
  4. If the referral notifies us that they were not authorised to be contacted by us, we will inform you that the referral is not qualified.
  5. We will lead the sales process and if the referral turns into a Qualified Referral:
    1. we will inform you;
    2. if needed, we will ask for your payment information;
    3. we will ask you to sign a self-billing agreement.

No referral fees will be eligible for payment until we receive your payment information and signed self-billing agreement from you.

  1. The Referral Reward Fee will be paid within thirty (30) days after the referral has paid the full membership fee.

 

MISCELLANEOUS

All such fees will be paid to you in the same currency paid by the referred member pursuant of the applicable membership agreement. 

We reserve the right in our sole discretion to make any determination under these rules, including, without limitation, the determination of your eligibility, a qualified referral and the amount and payment of the referral fee if we determine of your eligibility, a qualified referral and the amount and payment of the referral fee. If we determine, in our sole discretion, that you have violated these terms, you will not be eligible for the referral fee and we reserve the right to disqualify you from the referral program. Nothing in these grant you or any other party any right, title or license to use any of any of our trademarks or other intellectual property rights. By referring qualified referrals, you will not be deemed to be an employee of us. You will not act as an agent of us nor are you entitled to make any commitments on behalf of us. We reserve the right to amend these rules at any time without prior notice. 

 

You consent that we may transfer the personal information collected by us and make it available to our personnel. Advisors, professionals, subcontractors, independent consultants, external third party services providers and our affiliates for the foregoing purposes. We may transfer, and you consent. 

 

These terms of service and any dispute arising out of these terms (including any non-contractual disputes) will be governed by and interpreted according to English lay (but without giving effect to its conflict of laws rules or principles). 

 

Any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought by either party is less than £10,000 shall be referred to and finally resolved by arbitration under the London Court of International Arbitration Rules which Rules are deemed to be incorporated. Any claim which is not subject to arbitration pursuant to the foregoing paragraph shall be adjudicated exclusively in the English courts. Nothing in this Agreement shall prevent either party from seeking remedies in small claims courts of competent jurisdiction, or from seeking injunctive relief in any court of competent jurisdiction.
